TERMS AND CONDITIONS OF SALE
IDENTITY OF THE SELLER AND ORGANIZER
The website https://tenere-spirit-experience.com is operated by the company MB SPORTMOTOR, a SASU with a capital of €700, registered under SIRET number 801 950 098 00013.
Registered office: Chabreyras – 63580 Saint-Étienne-sur-Usson – France.
Trading name: Ténéré Spirit Experience.
PURPOSE AND ACCEPTANCE
These T define the terms of registration and participation in the activities offered by MB SPORTMOTOR. Any registration and payment of a deposit imply unreserved acceptance of these conditions.
NATURE OF SERVICES
“Ténéré Spirit Experience” Raids: Raid organization.
“Rally-Raid” Assistance Packs: Technical service provided to a participant entered in a third-party event.
Ténéré Centers: Outings supervised by a certified instructor.
CONDITIONS OF PARTICIPATION AND SAFETY
Aptitude: The participant certifies that they hold a valid driver’s license suitable for the category of motorcycle used, and that they are in a physical and psychological condition compatible with the practice of off-road motorcycling involved.
Rally-Raid Compliance: For Rally-Raid assistance services, the participant agrees to scrupulously respect the sporting and technical regulations of the event organizer. Any failure resulting in disqualification cannot give rise to a refund from MB SPORTMOTOR.
Equipment: Wearing full protective equipment (helmet, gloves, off-road boots, back protector, chest protection) is mandatory.
Have civil liability and repatriation insurance covering Morocco.
COMPLIANCE WITH REGULATIONS AND TRAFFIC LAWS
Local laws: The participant agrees to respect the laws and regulations in force in the country or region where the event takes place (France, Morocco, etc.).
Traffic laws: The participant is solely responsible for their driving. They must respect the local traffic laws in all circumstances. Any fine, ticket, or legal proceedings related to an infraction remains the exclusive responsibility of the participant.
Environment: The participant agrees to respect the environment, not to stray from authorized tracks, and to adopt respectful behavior toward local populations and wildlife.
ACCEPTANCE OF RISKS
The practice of motorcycle raids involves inherent risks: falls, injury, difficult weather conditions, or rugged terrain.
The participant acknowledges being aware of this and accepts these risks.
Registration and booking
Registration is confirmed after acceptance of these T and payment of the deposit or the full amount of the raid.
PRICE:
Prices include:
We mention in the programs or product sheets what is included in the prices.
Prices do not include:
Drinks, personal expenses, taxes, vehicle fuel, processing fees, vaccines, passport, and visa fees.
Vehicle insurance, cancellation guarantees, civil liability, accident, assistance, and repatriation are also not included.
Anything not indicated in the “prices include” paragraph.
PRICE REVISION:
Prices are established based on economic data: transport costs, fuel, and the exchange rate applied to the chosen trip. The organizer reserves the right to pass these variations on to the prices in full.
The sale price is always to be confirmed upon registration, and no modification can occur less than 30 days before the scheduled departure and will comply with legal provisions.
REGISTRATION:
The registration form provided for the RIDER must be completed and signed by the rider.
Registration is subject to availability and requires a 30% deposit, unless otherwise stated in the special conditions. Documents to be attached to the registration are: photocopies of the vehicle registration document and green card, civil liability, and repatriation insurance (mandatory).
No registration is accepted without the deposit and the supporting documents above.
BALANCE OF PAYMENT:
The balance must be paid in full no later than 30 days before departure. Any participant who has not paid the balance by the agreed date is considered to have cancelled their trip without being able to claim this cancellation and will not be entitled to recover the sums already paid.
For registrations occurring less than 30 days before departure, full payment of the price is required upon registration, accompanied by the aforementioned supporting documents.
ONLINE PAYMENT:
For all payments by bank transfer, credit card, or foreign check, bank fees are at your expense.
CANCELLATION AND TERMINATION
No right of withdrawal
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date.
By the participant:
More than 60 days before departure: Retention of the deposit (30%).
Between 60 and 31 days before: Retention of 50% of the total amount.
Less than 30 days before: Retention of 100% of the total amount.
By the Organizer (Force Majeure):
In the event of force majeure (war, natural disaster, pandemic, border closure, administrative decision, etc.), MB SPORTMOTOR reserves the right to cancel or postpone the event. In this case, the sums paid will either be refunded or converted into a credit note, after deduction of fixed costs already incurred.
TRANSPORT:
The organizer cannot be held responsible for changes to ports or airports (outbound and return) caused by external events such as technical incidents, strikes, bad weather, port or airport congestion, etc. Any costs (flights, boat, hotels, taxis, parking, etc.) remain the responsibility of the participant.
INSURANCE (MANDATORY)
The participant must provide proof of:
A Traffic Civil Liability Insurance for their motorcycle, valid in the country of the event.
An Assistance/Repatriation Insurance covering off-road motorcycling (and competition for Rallies). MB SPORTMOTOR declines all responsibility for rescue or medical costs not covered by the participant’s insurance.
MECHANICAL ASSISTANCE AND PARTS – EXCLUDING DESERT TOUR
MB SPORTMOTOR makes every effort to repair the vehicle but does not guarantee repair in the event of a major breakdown or unavailability of specific parts. Spare parts provided by the organizer are invoiced additionally.
NAVIGATION AND GPX TRACKS
Tracks are provided for information purposes only. The participant remains the sole master of their vehicle and must adapt their speed to the dangers of the terrain (dust, wadis, animals, other users). MB SPORTMOTOR is not responsible for falls or material damage occurring during navigation.
LIABILITY AND EXCLUSION
MB SPORTMOTOR declines all responsibility in the event of theft, loss of equipment, or bodily or material damage suffered by the participant. The organizer may exclude without refund any participant whose dangerous or disrespectful behavior would jeopardize the group or the image of the Ténéré Spirit Experience brand.
MODIFICATION OF THE PROGRAM
The organizer may modify the itinerary, stages, or accommodation for safety or organizational reasons.
IMAGE RIGHTS
Unless otherwise notified in writing, the participant authorizes MB SPORTMOTOR to use images (photos/videos) of the event for its communication.
PROTECTION OF PERSONAL DATA
As part of the registration for the event, the organizer is required to collect certain personal data concerning the participants (surname, first name, contact details, administrative documents, information relating to the motorcycle, etc.).
This data is collected solely for the purpose of managing registrations, organizing the event, participant safety, and communication relating to the event.
Personal data is kept for the duration strictly necessary for the organization of the event and the associated administrative management.
In accordance with current regulations relating to the protection of personal data, in particular the General Data Protection Regulation (GDPR), each participant has a right of access, rectification, limitation, opposition, and deletion of data concerning them.

The data collected is not transferred to third parties, unless this is necessary for the organization of the event (technical service providers, insurance, security services, or competent authorities).
APPLICABLE LAW AND MEDIATION
These T are subject to French law. In the event of a dispute, the courts of the registered office of MB SPORTMOTOR shall have exclusive jurisdiction.
